At the beginning of 2024, our NGO started providing support to a young woman who found herself in a complex and prolonged legal dispute to regain custody of her child. The child’s relatives have so far refused to return the child to the mother, despite the court ruling that there are no justified reasons for this refusal.
Case Development:
- County Court Decision (July 2024): The court recognized the young mother’s full (100%) custody rights, ruling that she is fully capable of caring for her child. Child protection specialists also supported this decision.
- Circuit Court Decision (November 2024): The second-instance court confirmed that the county court’s decision was correct.
- Current Situation: Thanks to our support and the assistance of Jaanika-Reilik Bakhoff, the mother has officially regained custody of her child. The Supreme Court upheld the circuit court’s ruling. More details can be found in our blog.
Role of the NGO:
Our NGO has assisted the young mother in organizing legal aid and covering the costs of expensive legal services. Thanks to this thorough effort, two court instances ruled that the young mother should be given the opportunity to rebuild a normal life with her child. In January, this decision was also confirmed by the Supreme Court. As a result, our support has helped ensure that the mother and child can now live a full and united life together.
